DESIGN DEFECTS

When manufacturers are designing and building products, they are supposed to learn how products perform under a wide variety of conditions. Although design defects should be identified and fixed during product testing, that does not always happen. Some manufacturers allow products to become available to consumers, even when there are known design defects.

  • Automotive components and tires
  • Helicopter fuel system design
  • Construction and heavy machinery equipment design defects
  • Everyday household consumer products and appliances
  • Sports and recreational equipment design
  • Toys and playground equipment design

IDENTIFYING AND EXPOSING KNOWN DEFECTS THROUGH PATENT RESEARCH

When we handle design defect cases, we thoroughly research the product. We review information from the U.S. Consumer Product Safety Commission (CPSC), police and government reports, and reports from the Occupational Safety and Health Administration (OSHA). Often, a history of consumer complaints is common.

We also conduct patent searches when we’re investigating defective products. By finding patents from manufacturers, we’re often able to prove that manufacturers knew about the design defects and failed to provide solutions.
